1. Introduction
Welcome to NeutralPlatformCommons ("we," "our," or "us"). These Terms & Conditions ("Terms") apply to your use of our yacht charter services and website found at neutralplatformcommons.sbs (the "Service") managed by NeutralPlatformCommons.
When you reserve a charter or use our Service, you accept these Terms. If you do not agree with any portion of these terms, then you should not use the Service.
2. Service Overview
At NeutralPlatformCommons, we offer luxurious yacht charter services, which include, but are not limited to:
- Daily yacht charters
- Sunset sails
- Business getaways
- Exclusive functions
- Extended charters
All offerings are contingent upon availability and suitable weather. We retain the right to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For booking a charter, you must:
- Be no younger than 18 years of age
- Submit true and complete information
- Make the necessary deposit as indicated in your booking conformation
- Consent to these Terms & Conditions
3.2 Confirmation
Confirmation of your booking occurs only once payment is received and we provide written confirmation. We hold the right to decline service to any individual at our discretion.
3.3 Availability
We subject all charters to the availability of vessels and appropriate weather conditions. Attempts will be made to accommodate your requested dates and times within reason.
4. Payment Terms
4.1 Pricing
All our listed prices are in € and incorporate all applicable taxes unless specified otherwise. Pricing can change at our discretion and without prior announcement.
4.2 Payment Schedule
- Deposit: A payment equalling 50% of the total cost of the charter is required at the time of booking
- Balance: To be paid in full 48 hours before the charter sets sail
- Incidental expenses (if any): Payable at the charter's conclusion
4.3 Payment Methods
Payments can be made using major credit cards, bank transfers, and verified cheques. We process payments using secure, encrypted protocols.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancellation occurs more than 72 hours before departure: Full refund minus any processing charges
- Between 24 and 72 hours before departure: Refund of 50%
- Less than 24 hours before departure: No refund will be given
5.2 Weather Cancellations
Should our captain determine weather conditions as unsafe, we will propose to:
- Reschedule the charter to an alternative date at no extra charge
- Issuing a full refund if rebooking is not achievable
5.3 Mechanical Issues
If your assigned vessel encounters mechanical issues, we will do our best to supply a comparable substitute. Should a substitute not be available, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all instructions given by the crew
- Utilize any safety gear provided when necessary
- Notify us of any health conditions that could affect their security
- Stay within designated areas on the vessel
6.2 Prohibited Items
The following items are not allowed on board:
- Containers made of glass
- Illegal substances
- Firearms or other weaponry
- Excessive beverages (outside of reasonable personal consumption)
- Animals (unless approved in advance)
6.3 Conduct
All passengers are expected to behave respectfully and considerately. A charter may be terminated prematurely without a refund if behavior of any passenger presents a risk to safety or detracts from the experience of others.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the amounts paid by you for your charter. We are not accountable for:
- Injuries to persons resulting from their own lack of caution
- The loss or damage of personal belongings
- Indirect or subsequent damages that are punitive in nature
- Delays due to weather or situations out of our control
7.2 Insurance Coverage
We uphold comprehensive maritime insurance that encompasses both our vessels and business practices. Passengers bear responsibility for ensuring they have appropriate travel and personal insurance coverage.
7.3 Assumption of Risk
By engaging in our charter services, you acknowledge the inherent risks associated with maritime activities and agree to assume all responsibility for the safety and security of your person.
8. Modifications and Itinerary Changes
We may revise itineraries, paths, or schedules due to factors such as weather conditions, safety concerns, or operational needs. We strive to offer comparable alternatives wherever possible.
9. Force Majeure
Events outside our control that may cause delays, cancellations, or changes are not our fault, and include, but are not limited to:
- Extreme weather patterns
- Catastrophic natural occurrences
- Government decrees
- Shut down of ports
- Outages of equipment
10. Privacy and Data Protection
We respect your personal data in line with our Privacy Policy. Utilizing our services signifies agreement to the processing of your personal details as outlined by our Privacy Policy.
11. Intellectual Property
Our website's content, including text, graphics, logos, and imagery, is safeguarded by copyright and trademark regulations. Unauthorized replication, distribution or derivative work creation is forbidden without our express consent.
12. Governing Law
Applicable laws within Germany govern these Terms. All disputes will be resolved in courts located in Hamburg, Germany.
13. Changes to Terms
We may adjust these Terms as needed. Modifications will be published on our website with a notice of the amendment date. Using our services after these changes implies acceptance of the new terms.
